A significant number of Internet and Social media users do not hesitate to freely insult and threaten people who are hostile among themselves or people that they do not like their thoughts, even though they do not know them, through their own accounts or fake accounts they have created just for this reason. However, the Law does not require the perpetrator and the victim to actually be in the same environment and face to face in order to commit the crime of threat.

How does a threat crime occur?

Threat crime occurs when a person is informed that he or she will be subjected to undue harm or malice. For the threat offense to occur, it is sufficient to inform the victim that he or she will suffer a serious and unjust damage. As it is same in the offense of defamation, there is no requirement such as “only to be committed face to face” in order for a threat crime to occur. In other words, the Law does not seek for the perpetrator and the victim to actually be face to face in the same environment in order to commit the crime of threat.

In the threat crime, just like the insult crime, the complaint appears as a condition of the lawsuit. Therefore, the victim's complaint is needed for the threat crime to be investigated and prosecuted. The person threatened by message or internet must first file a criminal complaint. In this case, a criminal complaint can be made to the relevant Public Prosecutor's Office or to the police station. Since it is very difficult to prove the crime , it is very important for the threatened victim to share the existing conversations about the crime with the prosecutor's office in order to identify the perpetrator.
